Welcome to Blind Tunes! These Terms of Service (“Terms”) govern your use of the blindtunes.com website and Blind Tunes application (the “Service”) operated by Blind Tunes (“we,” “our,” or “us”).

3. How Blind Tunes Works
Blind Tunes is a music ranking game that allows you to:
Create playlists of songs or videos
Rank content without knowing what you’re listening to (“blind” ranking)
Share playlists with friends
Compare rankings with other players
Compete in tournament and versus modes
4. Third-Party Content
Blind Tunes provides access to content from third-party services:
Apple Music
Song previews, artwork, and metadata are provided by Apple Music. This content is subject to Apple’s Terms of Service. We do not host or control this content.
YouTube
Video content is embedded from YouTube and is subject to YouTube’s Terms of Service. We do not host, upload, or control YouTube content.
Content Disclaimer
Important: Music and video content accessible through Blind Tunes may contain explicit language, mature themes, or content that some users may find objectionable. We do not control, screen, or endorse third-party content. You access such content at your own discretion and risk.
5. User-Generated Content
When you create playlists or share content, you retain ownership of your selections and arrangements. However, you grant us a license to store, display, and share your playlists as necessary to operate the Service (for example, when you share a playlist with friends).
You agree not to create playlists or content that:
Infringes on others’ intellectual property rights
Contains illegal content
Harasses or threatens others
Impersonates another person or entity
6. Premium Purchases and Refunds
Blind Tunes offers a premium upgrade for a one-time purchase price as displayed on the Premium page at the time of purchase. Premium is a lifetime upgrade tied to your account and includes access to additional features such as unlimited plays, tournament mode, and versus mode.
Payments
All payments are processed securely through Stripe. We do not store your credit card or payment details. By completing a purchase, you agree to Stripe’s Terms of Service.
Refunds
You may request a refund within 7 days of your purchase date by contacting us at support@blindtunes.com. Refund requests made after 7 days from the date of purchase will not be honored. When a refund is issued, your premium access will be revoked.
We reserve the right to deny refund requests if we determine that premium features have been extensively used, or if we detect abuse of the refund process such as repeated purchases and refund requests.
Price Changes
We reserve the right to change the premium price at any time. Price changes do not affect existing purchases. If you have already purchased premium, your access remains lifetime regardless of future pricing.
7. Prohibited Conduct
You agree not to:
Use the Service for any illegal purpose
Attempt to hack, disrupt, or overload our systems
Create multiple accounts to abuse the Service
Use bots or automated tools without permission
Circumvent security measures or rate limits
Scrape or collect data from the Service without permission
Use the Service to spam or harass others
8. Intellectual Property
The Blind Tunes name, logo, website design, and original code are our property. You may not copy, modify, or distribute our intellectual property without permission.
Music, artwork, and videos displayed in the Service are the property of their respective owners (artists, labels, content creators).
9. Disclaimer of Warranties
Blind Tunes is provided “as is” and “as available” without warranties of any kind. We do not guarantee that:
The Service will be uninterrupted or error-free
Content from third parties will always be available
The Service will meet your specific requirements
10. Limitation of Liability
To the maximum extent permitted by law, Blind Tunes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the Service.
11. Indemnification
You agree to indemnify and hold harmless Blind Tunes from any claims, damages, or expenses arising from your violation of these Terms or your use of the Service.
12. Termination
We may suspend or terminate your access to the Service at any time, for any reason, including violation of these Terms. You may delete your account at any time through your Profile page.
Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that should survive termination will remain in effect.
13. Changes to Terms
We may modify these Terms at any time. We will notify you of significant changes by posting a notice on the website. Your continued use of the Service after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Utah.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
